Mulberry Fork Paddling Co.'s Waiver
Assumption of Risk & Liability Release
By renting a kayak from Mulberry Fork Paddling Co., I accept full responsibility for any damages, injuries, or accidents that may occur while using the rented equipment, regardless of its condition. I acknowledge that kayaking and water sports come with inherent risks, including but not limited to physical or emotional injury, paralysis, death, or damage to property. I confirm that I have the necessary skills to safely operate the rented equipment and that I will use it according to recommended guidelines.
By signing this agreement, I waive my right to pursue legal action for compensation or any other remedy for injuries, property damage, or death caused by my participation in Mulberry Fork Paddling Co. activities. I agree to release Mulberry Fork Paddling Co., its officers, agents, and employees from any claims or demands, including claims of negligence, arising from my use of the rental equipment.
Equipment Usage & Responsibility
I acknowledge that Mulberry Fork Paddling Co. provides safety devices such as life vests, and that it is my responsibility to inspect and properly use all equipment, including kayaks, paddles, and life-saving gear. I assume full responsibility for the safe use of all equipment and agree to hold Mulberry Fork Paddling Co. harmless from any liability or injury arising from improper use.
If I lose or damage any rental items, I agree to pay the replacement or repair costs listed below. If Mulberry Fork Paddling Co. incurs costs to recover payments, I will reimburse them for those expenses in addition to the cost of lost or damaged items.

Additional Terms & Conditions
I understand that I am responsible for securing all kayaks, paddles, life jackets, and other equipment when transporting them. I acknowledge that loading or unloading kayaks may cause damage to property or persons, and I assume full responsibility for any such damages. If I choose to have Mulberry Fork Paddling Co. staff assist with loading/unloading, I agree not to hold the company or its staff liable for any damages that may occur during the process.
I also agree that if the rental equipment is not returned within 3 working days of the due date, Mulberry Fork Paddling Co. is authorized to charge the full retail price of the products to my credit card. In the event of damage or loss, Mulberry Fork Paddling Co. has sole discretion to determine whether the equipment will be repaired or replaced, with costs charged to my credit card accordingly.
By signing in the Kayak Booking Form, I certify that I have carefully read and understood this agreement, and I voluntarily agree to its terms.
